Bending the Rules?
The price sign was granted as a ZBA variance with the understanding that nothing would be posted on the supporting pole to block the corner clear vision zone. After the variance was granted, a drive up telephone was installed further blocking the clear vision zone. Someone does not know the limits of the variance granted or feels that the added signs are protected speech.
However, to be fair, one must take into account the economics of operating a gasoline station. The profit margin on selling gasoline is so small that sales of soda, cigarettes, and snacks are a major source of income. There may also be a provision in the law that appellants before the ZBA are not bound by restrictions placed on a variance they are granted if a greater profit may be had by more sinage.
NOTICE: It is assumed that all sinage you see here is there by permit, common law, by right or approved by the appropriate official. Various zoning and public safety ordnances may place limitations on signs in terms of content, placement, style, size, and number per parcel.
